The ruling that opened the door
The Hawaii Rifle Association, joined by Virginia resident John Solinsky, challenged Hawaii's non-resident ban as a violation of the Second Amendment as applied through Bruen. The federal district court agreed: a blanket bar on non-residents obtaining a carry license, in a state that issues to residents, cannot survive Bruen's text-and-history test.
The court would ordinarily have voided the statute universally. But Trump v. Casa changed the remedial landscape — federal courts can no longer issue nationwide or 'universal' injunctions against statutes. Relief flows only to the parties who actually sued.
The parties who sued are the Hawaii Rifle Association and its members. That's the entire legal basis for the current non-resident pathway: HRA members inherit the plaintiffs' standing and can apply under the same reasoning.
What HRA membership actually gets you
Standing under the ruling is the headline benefit. Without it, a county Chief of Police has a straightforward reason to return a non-resident packet on statutory grounds.
Membership also funds continued litigation. HRA's legal team is actively working to broaden the pathway — either through additional plaintiffs or through a legislative fix — and members receive updates on both fronts.
Ancillary benefits include access to member group shoots on Oahu and the neighbor islands, educational events, and a network of local sponsors and instructors who prioritize member scheduling.
Will the requirement change?
It might. Two paths are in motion. First, additional non-resident plaintiffs could be added to the case, expanding the class beyond HRA. Second, the Hawaii legislature could clean up the underlying statute in a way that resolves the constitutional issue without requiring membership.
Both take time. In the meantime, HRA membership is the accepted route, and starting there costs you very little while positioning you to move immediately when a pathway is confirmed.
How to prove standing in your packet
Print your HRA confirmation email and include it in the packet directly behind your application form. Add a screenshot of your active member profile with the join date and expiration date visible. If HRA issues a physical or digital membership card, include a copy.
